2. Nature of the service

Willway provides a self-service will-preparation facility for individuals whose circumstances fall within the eligibility criteria set out on this website.

The service uses information supplied by customers through an online questionnaire to prepare a document intended to record their testamentary wishes.

Willway is not a law firm and does not provide legal advice.

Willway is not authorised or regulated by the Solicitors Regulation Authority (SRA) or the Legal Services Board. The will-preparation service is not presented as a regulated legal service.

The service is designed for straightforward circumstances only. It is not suitable for everyone, and customers whose circumstances fall outside the stated eligibility criteria will not be able to proceed.

3. No legal advice

The information, explanations and documents provided through Willway are general in nature and are not a substitute for advice from a suitably qualified legal professional.

Willway does not advise customers on:

  • Whether making a will is appropriate for their particular circumstances.
  • The legal or financial consequences of particular gifts or inheritance arrangements.
  • Inheritance tax, estate planning or other tax matters.
  • The suitability of particular executors, guardians, trustees or beneficiaries.
  • Potential claims against an estate.
  • Complex family, property, business or overseas asset arrangements.

Customers are responsible for the information and instructions they provide and for deciding whether the Willway service is appropriate for their needs.

If you are uncertain about your circumstances or the effect of a proposed provision, you should obtain independent legal advice before proceeding.

4. Preparation and execution of your will

Willway prepares a document based on the information and instructions provided by the customer.

Payment for the service, or receipt of a PDF or printed document, does not by itself create a legally valid will.

For a will to take effect, it must satisfy the applicable legal requirements, including the requirements for signing and witnessing.

Customers are responsible for following the signing instructions supplied with their document. In particular, they must ensure that the will is properly signed and witnessed in accordance with the law of England and Wales.

Willway cannot guarantee that a document will be valid or achieve a particular legal outcome in every individual circumstance.

5. Geographic scope

The Willway service is intended only for individuals who are domiciled or ordinarily resident in England and Wales and whose estate and circumstances fall within the eligibility criteria stated on the website.

The service is not designed for individuals with assets outside the United Kingdom, business or agricultural interests, complex trust arrangements or other circumstances excluded by the eligibility checker.

The service is prepared on the basis of the law of England and Wales.

6. Intellectual property

Unless otherwise stated, the content of this website, including its text, branding, design, graphics and materials, belongs to Willway or is used with permission.

You may use documents prepared for you through the service for your own personal purposes. You must not reproduce, distribute, sell, commercially exploit or otherwise use Willway's website content or materials without prior written permission, except where permitted by law.

7. Website information

We take reasonable care to ensure that information on this website is accurate and up to date. However, information is provided for general information purposes and may not reflect changes in legislation or your individual circumstances.

We may update, amend or withdraw website content and features from time to time.

Nothing in this notice excludes or limits any liability or right which cannot lawfully be excluded or limited.
