Your will questionnaire

Write your will

We’ll start with a few short eligibility checks, then guide you through ten steps. You can go back at any point, and you’ll review everything before you pay. Please use full legal names throughout.

First, a few eligibility checks

These questions confirm that WillWay’s standard service is right for you. If it isn’t, we’ll explain why and suggest where to go instead.

Before you start

WillWay is not a law firm. We are not solicitors, we are not regulated by the Solicitors Regulation Authority and we don’t give legal advice. Our service helps you prepare your own will from your own instructions, and you are responsible for the choices you make. If you’re unsure about anything, speak to a solicitor.

WillWay is the trading name of Wellevia Limited (company number 16553905), which looks after your answers. Unless you choose to keep them on this device, your answers stay in this browser tab only while you work. When you continue to payment, they’re attached to your order so your will can be produced, and they’re cleared from this device once your order is placed. We also ask your browser not to remember the details of the people you name. Read our privacy policy.

Legal requirements

Are you aged 18 or over? (Required)
Do you understand what a will does, what you own, and who would benefit from your will? (Required)
Are you making this will of your own free will, without pressure or influence from anyone else? (Required)
Do you want this to be your only will, replacing any wills you have made before? (Required)

Where you live and what you own

Do you live in England or Wales, with no assets outside the UK? (Required)
Are your assets straightforward, with no business, farm or private company shares? (Required)

Keeping things straightforward

Apart from holding a beneficiary’s share until they reach the age you choose (18, 21 or 25), do you want a simple will with no other trusts and no beneficiary who lacks mental capacity? (Required)
Is it unlikely that anyone will bring a legal claim against your estate? (Required)
Apart from your own children under 18, is anyone financially dependent on you, or could anyone reasonably expect to receive something from your estate? (Required)

Don’t count your own children under 18 here. We ask about them later. Do count, for example, a partner you live with but aren’t married to, an adult child, a stepchild, a former spouse, or anyone else you support financially.

Your family circumstances

Are you planning to marry or enter a civil partnership? (Required)
Are you going through a divorce, dissolution or separation? (Required)
Do you have parental responsibility for each of your children under 18? (Required)

Parental responsibility means the legal rights and duties of a parent. Birth mothers have it automatically; fathers and second parents usually do if they were married to the mother or are named on the birth certificate.

Does anyone else have parental responsibility for any of your children under 18? (Required)

For example, the children’s other parent.

Is there a court order or other arrangement affecting who your children live with, or who has parental responsibility? (Required)
